The lawyer for Thunder Bay Justice Patrick Smith says the fight is not over yet.
The Canadian Judicial Council ruled Smith was wrong to accept a temporary dean’s position at the Lakehead University’s law school.
The council also ruled Justice Smith was motivated by a sincere desire to help the law school and could continue his judicial duties.
However, his lawyer Brian Gover is determined to clear the judge’s name and is surprised the ruling came before his court hearing which was meant to postpone the decision.
Gover explains there is a principle that tribunal stands down in the face of an ongoing court application which he claims the Canadian Judicial Council ignored.
The Toronto lawyer says he and his client will be continuing with the court review to quash the ruling and to clear Justice Smith’s name entirely.
That hearing is scheduled for November 20th.
